Post Can someone help with this one???

I bought an item off ebay, paid via paypal, received the item and it was DISGUSTING!! A lounge covered in dog urine, ripped, insect nests... need I go on?? I filed a claim and paypal said I could get a full refund if I returned the item to the seller which I did. The transport company got the seller to sign a receipt acknowledging she had received the item back. Paypal will not accept this as evidence the seller has the item, so I got the transport company to sign a statement on their official letterhead etc evidencing the return. Paypal said they still this is not good enough! So I asked them if they had checked with the seller whether she had the item returned. She has ignored their requests for confirmation and they told me she was "under no obligation to respond". They say they want online tracking evidence. Am I right in saying that their policy states online proof of delivery with a seller's signature (which I've provided) and I also see the seller IS obliged to respond or else they will rule in the buyer's favour??? Their policy is different for Australia in terms of online tracking. This seller owes me $300 and I have sought legal advice today and also Fair Trading. What else can I do to resolve this as the dispute is about to close????????? You can't send lounge suites through Australia Post!!!!!!!!

First, I would not talk to Paypal, put everything in writing. If they don't respond, or just refer you to the TOS, save the emails. Print out everything you have in writing. I'm hoping you took pictures of the disgusting item, but if not, no matter. Take all of your paperwork, receipts from the shipping company, etc, and if in Oz you have a small claims court - where you can represent yourself for a small filing fee, you will have your day in court and deal with the seller directly. Make sure to sue for all of your fees and court costs. I think you must byp*** paypal in this case and sue the seller directly, as I ***ume it was a local sale. good luck.
