Default Paypal awards dispute to a thief.

Here's what happened:

A relatively new buyer with 10 feedbacks bought a few items from me on e-bay, totalling $1700. I sent him the merchandise by USPS insured mail. When i sent it, I was told that Insurance was trackable and of course he has to sign for it. Few days later, the buyer/scammer files Paypal dispute stating he did not receive the package. I went to my post office, they tracked the parcel in the system and shows the parcel was delivered and signed for by the buyer. Buyer never communicated with me. Tried to contact him, invalid phone number, etc.. I faxed all the info to Paypal showing that the buyer received merchandise. Few days later, Paypal awards the claim in favor of the buyer. This thief now disappeared (no longer registered on e-bay) has merchandise and the money.

I called Paypal numerous times, they gave me runaround stating that the usps insurance tracking is not good enough even though I faxed them copies showing the buyer received merchandise, even his siganture was displayed. The way this company operates is frightning, aiding criminals.

I'm seeking more advice in this matter and most likely will take Paypal to court. I will never do business with this company again.

I'm so sorry to hear that. I hope you will be able to take Paypal to court and should be suprised if you don't win your case. I have heard this kind of story countless times. Not only am I disgusted with Paypal, Ebay itself is also beginning to pi** me off. I have heard that they now force sellers to list Paypal as one of the payment options, otherwise they will delete your listing, although I'm not sure if this only applies to Business sellers. (This would be in the UK).

I just think it's interesting the way corporate greed gradually takes over once again. The original founder of Ebay was probably a good, down to earth guy, and once everything got bigger and bigger and they bought Paypal......Yeuck.

How disgusting that a huge company like Paypal/Ebay who make billions would treat an ordinary person who's just trying to make a few bucks this way.

In your case they're clearly in breach of their own regulations.

I am in the same boat and what annoys me about the situation is that as a buyer & seller on eBay I've been on both sides of the coin and guess what? STILL LOSE!

Seller's POV:

- In May, a buyer purchased a game from me for £51.
- Their address is "confirmed" by Paypal.
- I sent goods to the address provided via. Royal Mail Special Delivery (the safest method available from Royal Mail - UKs principal courier -- next day delivery, insurance up to £500).
- Almost 2 months later, Paypal notify me of chargeback. Reason "item not received".
- I tracked the package (ZC869234280GB), provided tracking to Paypal and faxed them the post office receipts; Royal Mail confirm that it was delivered.
- Paypal claimed that it is covered under the Seller Protection Policy as long as I meet certain conditions. As the package does not say where it was delivered ON THE RM WEBSITE (even though Royal Mail can provide this in writing & Paypal KNOW that RM some times do not provide this online- they EVEN have it in writing in their terms & conditions), they would not cover it. I reminded them that I do not work for Royal Mail and they didn't care less.
- They took the £51 from my account + £7 handling fee.
- I contacted Royal Mail to inform them that I lost a chargeback because there was no signature on their website. They wrote back to say that they were satisfied that the package had been delivered and would not refund me.
- The police also contacted me to confirm that there was fraud involved and that the cardholder's card had been used w/out his authorisation. That really shouldn't concern Paypal's Seller Exploitation Policy which claims to cover sellers against fraud.

*Sigh*

On the other side of the coin [buyer's POV]:

I recently bought a "phone" on eBay. The listing title said "Sony Ericsson W960i" and there was a huge body of text relating to the phone. I stumbled on the auction in its final 2 or so mins, skim read the auction & bid in the last seconds - I (unfortunately) "won" the auction.

I paid the £126 using my cc via. Paypal (the ONLY way that I will pay) and email the seller to tell them that I had wanted the phone for my brother's birthday. He replied that he would not be able to send it for another week- as his local post office would be closed for a week (I was too anxious to hear the alarm bells). I replied that in that case I would *have to* look elsewhere. He then quickly had a change of heart and said that he would have it to me for tomorrow. I said fine and waited in for the package. No idea how, but Royal Mail somehow missed delivery. On the website, it said in the "print name" section my name crossed out and in the signature section "N/A 759 left" -- I can only ***ume that to save time the postman/woman had written my name & waited for the signature but had not received it and so crossed it out. Who knows? Point is, I hadn't received the package.

I then went to contact the seller and noticed that he had received negative feedback from another buyer on the exact same item. I contacted her to ask what happened and she told me that if I read line 21 of the huge body of text that it says, "please note you will only receive a charger."

This is the body of text that it is in:

Sad to report there are still teeny tiny touch icons which require some precise fingertip control to hit accurately. Sure, you could pull out the stylus from its housing on the phone, but that's an extra process and one many users will get fed up with quickly.

Sometimes finding what you want is also a challenge. You want to get to the video player? Work out that the touch button with four dots on it takes you to the main menu and cruise around the icons. please note you will only receive a charger. Find the one marked ‘Multimedia' and select it. Camera, RSS feeds, PlayNow, Picture Gallery, More applications. "


So not only had I not received the package, but the package that I was fighting to receive a £126 charger!! I quickly launched a dispute & the seller (confident that Paypal's as bent as he is) escalated it to a claim. He provided the tracking number (yes, that one with the signature "N/A 759 left") and Paypal... Wait for it....

Sided with the seller & awarded him the £126!

*Sigh*

I am sick & tired of dealing with them and so I had to contact my cc company and hope that they can fight the good fight on my behalf. As for the game- I shan't give up on that, I will write letter upon letter to Paypal / FSA / Royal Mail / the Police -- anyone who has a mailing address until I get my £51 & damages...

I too am in the same situation as you peeps, I sold a cell phone on ebay for like $320 the buyer filed a dispute with paypal like two weeks later. I sent the item with insurance thinking they could track it online also got delivery confirmation but lost the receipt. I faxed, scanned and emailed all of the do***ents from the USPS post office showing the item being delivered. They would not accept anything. Only online tracking, if you do not have this forget it. The scammer wins the honest lose.
